Article 1: General provisions


The e-commerce website of Jar&Joy, a registered company with its registered office at Agoralaan building B, 3590 Diepenbeek, Jar&Joy offers its customers the opportunity to purchase products from its online shop.

 

The present General Terms and Conditions ("Terms") apply to every order placed by a visitor of this e-commerce website (“Customer”). When placing an order through the Jar&Joy web shop, the Customer must expressly accept these Terms, thereby agreeing to their applicability, to the exclusion of all other terms. Additional terms from the Customer are excluded, unless they have been expressly accepted in writing by Jar&Joy in advance.


Article 2: Price


All stated prices are expressed in EURO, always including VAT and all other taxes or charges that the Customer is obliged to bear.

 

The price stated refers solely to the items as described in the text. The accompanying photos are intended for decorative purposes and may contain elements that are not included in the price.


Article 3: Offer


Despite the fact that the online catalogue and the e-commerce website are compiled with the utmost care, it is still possible that the information provided is incomplete, contains material errors, or is not up to date. Obvious mistakes or errors in the offer do not bind Jar&Joy. Jar&Joy is only obliged to a best-efforts commitment regarding the accuracy and completeness of the information provided. Jar&Joy is in no case liable in the event of manifest material errors, typographical or printing errors.


When the Customer has specific questions regarding e.g. sizes, colour, availability, delivery time or delivery method, we request the Customer to contact our customer service in advance.


The offer is valid as long as stocks last and can be adjusted or withdrawn by Jar&Joy at any time. Jar&Joy cannot be held liable for the unavailability of a product. If an offer has a limited validity period or is subject to conditions, this will be explicitly stated in the offer.


Article 4: Online purchases


Follow the steps below to place your order easily and securely:

1. Open the desired product on our website.

2. Select the desired quantity.

3. Add the item to your shopping cart using the ‘Add to cart’ button.

4. Open your shopping cart to view your selection.

5. In your shopping cart, you will see an overview of the selected products, including prices and any shipping costs. Here, you can adjust the quantity or remove items if desired.

6. If your shopping cart is to your liking, click on 'Proceed to payment'.

7. Fill in your personal details, such as name, delivery address, email address, and billing information, so that we can process your order correctly.

8. Click on 'Next' to continue.

9. Choose the desired shipping method. The associated costs and estimated delivery time will be clearly displayed.

10. Select your preferred payment method.

11. You will receive a complete overview of your order, including the total amount, shipping costs, and delivery information. To proceed, you must agree to our terms and conditions.

12. After confirmation, you will be redirected to the secure payment environment of the chosen payment provider to complete the payment.

13. After a successful payment, you will receive a confirmation of your order by email, including the order details and a summary invoice.


The Customer has the choice between the following payment methods:

- via credit card

- via bank card

- via bank transfer to account number BE…

- IDEAL (for Dutch customers)

- PayPal


Jar&Joy is entitled to refuse an order due to a serious breach by the Customer regarding orders in which the Customer is involved.


Article 5: Delivery and execution of the agreement


After completing your order and receiving your payment, your order will be processed. You will receive a confirmation of your order via email, which serves as the establishment of the agreement. The execution of the agreement will proceed in accordance with the provisions of our general terms and conditions.

As soon as the payment is received, your order will be prepared for dispatch. Delivery is made via DHL or Bpost, depending on your choice and delivery address. You will receive a shipping confirmation by email with a tracking number as soon as your order has been dispatched. Deliveries will take place at the address you provided. We kindly ask you to always provide accurate and complete information.


 Items ordered through this online store will be delivered in Belgium & the Netherlands.

Delivery times depend on the destination of the delivery:

- Within Belgium: delivery within 2 to 5 working days after receipt of payment.

- To the Netherlands: delivery within 3 to 7 working days.

In the case of customisation or temporary unavailability of a product, the delivery time may vary. In such cases, you will be informed in good time.

The shipping costs are clearly displayed during the checkout process and depend on the delivery address and the weight of the order:

- Within Belgium: fixed rate of €4.95 – free delivery from €75.

- To the Netherlands: fixed rate of €6.95 – free delivery on orders over €75.


The delivery is carried out via an external courier service (DHL or Bpost), with a delivery time of 2 to 7 working days depending on the destination. The associated shipping costs are as described above.

Unless otherwise agreed or expressly stipulated, the goods will be delivered to the address specified by the Customer within a maximum period of 30 days after receipt of the order.


Any visible damage and/or qualitative shortcoming of an item or any other deficiency in the delivery must be reported by the Customer to Jar&Joy without delay.


The risk of loss or damage to the goods passes to the Customer as soon as they (or a third party designated by them who is not the carrier) have physically taken receipt of the goods. If the Customer designates a carrier that was not offered by us, the risk will already pass to the Customer upon transfer to that carrier.


Article 6: Retention of Title


The delivered items remain the exclusive property of Jar&Joy until the moment of full payment by the Customer.

The Customer undertakes to inform third parties of the ownership retention of Jar&Joy if necessary, e.g. to anyone who might seize the articles that have not yet been fully paid for.


Article 7: Right of Withdrawal


The provisions of this article apply only to Customers who purchase items online from Jar&Joy in their capacity as consumers.

 

The Customer has the right to withdraw from the agreement within a period of 14 calendar days without giving any reason.

 

The withdrawal period expires 14 calendar days after the day:

 - in the case of service contracts or digital content not supplied on a tangible medium: "from the conclusion of the contract";

- for sales agreements (including agreements that concern both goods and services): "on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the good."

- for agreements where the Customer has ordered multiple goods in the same order that are delivered separately: "on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the last good.";

- for agreements concerning the delivery of a good consisting of various shipments or parts: "on which the Customer or a third party designated by the Customer, who is not the carrier, physically takes possession of the last shipment or the last part."

 - for agreements concerning the regular delivery of goods over a specified period: "on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the first good.".

 

To exercise the right of withdrawal, the Customer must contact Jar&Joy, Agoralaan building B, 3590 Diepenbeek,  +32 494 88 85 60 (Kjelle Revets),  +32 471 44 83 88 (Sarah Vandeplas),  +32 492 78 94 80 (Ilona Cuppens), jar.and.joy2025@gmail.com by means of an unequivocal statement (e.g. in writing by post, fax or email) informing of his decision to withdraw from the agreement. The Customer may use the attached model withdrawal form for this purpose, but is not obliged to do so.


To comply with the withdrawal period, the Customer must send their notification regarding the exercise of the right of withdrawal before the withdrawal period has expired.


The Customer must return the goods without delay, but in any case no later than 14 calendar days after the day on which he communicated his decision to withdraw from the agreement to Jar&Joy, either by sending them back or handing them over to Jar&Joy, Agoralaan building B, 3590 Diepenbeek. The Customer is considered to be on time if he sends the goods back before the 14 calendar day period has expired.


The direct costs of returning the goods shall be borne by the Customer.


The Customer is requested to return the items in their original condition and packaging, along with all accompanying accessories and instructions. If the returned product has in any way diminished in value, […] reserves the right to hold the Customer liable and to claim compensation for any depreciation of the goods resulting from the Customer's use of the goods that goes beyond what is necessary to establish the nature, characteristics, and functioning of the goods.


All returned items are carefully examined. The principle here is that the consumer may only inspect the item as they would be allowed to do in a shop. Returned items may be tried on, but must not have been used. If an item has depreciated in value due to the Customer's use, this will be charged to the Customer.

 

"If the Customer has requested that the provision of services commence during the withdrawal period, the Customer shall pay an amount that is proportional to what has already been delivered at the time they informed us of their intention to withdraw from the agreement, compared to the full performance of the agreement."

 

If the Customer cancels the agreement, Jar&Joy will refund all payments received from the Customer up to that point, including standard delivery costs, within a maximum of 14 calendar days after Jar&Joy has been informed of the Customer's decision to cancel the agreement. In the case of sales agreements, Jar&Joy may withhold the refund until it has received all goods back, or until the Customer has provided proof that they have returned the goods, whichever occurs first.

 

Any additional costs resulting from the Customer's choice of a delivery method other than the cheapest standard delivery offered by Jar&Joy will not be refunded.

 

Jar&Joy will refund the Customer using the same payment method that the Customer used for the original transaction, unless the Customer has expressly agreed otherwise; in any case, the Customer will not be charged any fees for such a refund.


The Customer cannot exercise the right of withdrawal for:

- service agreements after the full execution of the service;

-the delivery or provision of goods or services whose price is linked to fluctuations in the financial market over which Jar&Joy has no control and which may occur within the withdrawal period;

- the delivery of goods manufactured according to the specifications of the Customer, or those clearly intended for a specific person;

- the delivery of goods that are perishable or have a limited shelf life;

- the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery;

- the delivery of goods that, after delivery, have been irrevocably mixed with other products by their nature;

- the delivery of alcoholic beverages for which the price has been agreed upon at the conclusion of the sales agreement, but which can only be delivered after 30 days, and whose actual value depends on market fluctuations over which the business has no control;

- agreements where the Customer has specifically requested to visit him to carry out urgent repairs or maintenance;

- the delivery of sealed audio and sealed video recordings and sealed computer software, the seal of which has been broken after delivery;

- the delivery of newspapers, periodicals or magazines, excluding agreements for a subscription to such publications;

- agreements that have been concluded during a public auction;

- the provision of accommodation other than for residential purposes, goods transport, car rental services, catering and services related to leisure activities, if a specific date or period of execution is provided for in the agreements;

- the delivery of digital content that is not supplied on a tangible medium, provided that the performance has begun with the express prior consent of the Customer and that the Customer has acknowledged that they lose their right of withdrawal as a result (e.g. downloading music, software);

- the agreements for services for betting and lotteries.


Article 8: Guarantee


According to article 1649quater of the old Civil Code, the consumer has statutory rights. This statutory guarantee lasts for two years and is valid from the date of delivery to the first owner. Any commercial guarantee does not affect these rights.


To make a claim under the warranty, the Customer must be able to provide proof of purchase. Customers are advised to keep the original packaging of the goods.


For items purchased online and delivered to the Customer's home, the Customer must contact the Jar&Joy customer service and return the item to Jar&Joy.


Upon discovering a defect, the Customer must inform Jar&Joy as soon as possible. In any case, any defect must be reported within a period of 14 days after it has been identified by the Customer. Thereafter, any right to repair or replacement shall expire.

 

The (commercial and/or statutory) warranty does not apply to defects arising from accidents, neglect, falls, use of the item contrary to the purpose for which it was designed, failure to comply with the instructions for use or manual, modifications or alterations to the item, rough handling, poor maintenance, or any other abnormal or incorrect use.

Article 10: Sanctions for Non-Payment


Unless expressly agreed otherwise in writing, the invoice is payable in cash. In the event of non-payment of the whole or part of the price, the provisions of Book XIX of the Economic Law Code shall apply, and the seller will send the customer a free reminder to pay the amount due within 14 calendar days. If the customer does not pay within that period, the outstanding amount will be increased by an annual interest calculated at the reference interest rate plus eight percentage points as referred to in Article 5, second paragraph, of the law of 2 August 2002 on combating payment arrears in commercial transactions, calculated from the calendar day following the day on which the free reminder was sent to the customer, as well as a flat-rate compensation of:

- 20 euros if the outstanding balance is less than or equal to 150 euros;

- 30 euros increased by 10% of the amount due on the band between 150.01 and 500 euros if the amount due is between 150.01 and 500 euros;

-65 euros increased by 5% of the amount owed on the portion above 500 euros, with a maximum of 2000 euros if the outstanding balance is higher than 500 euros.


Notwithstanding the above, Jar&Joy reserves the right to reclaim items that have not been (fully) paid for.


Article 11: Privacy


The data controller, Jar&Joy, respects the General Data Protection Regulation and the Belgian Privacy Act of 30 July 2018.


The personal data you have provided will only be used for the following purposes: processing and delivering your order, managing your account, providing customer service, sending newsletters (if you have subscribed to this), and for personalised advertising and marketing purposes. The legal grounds are: the performance of the contract, your consent (for example, for marketing and newsletters), fulfilling legal and regulatory obligations (such as accounting obligations), and the legitimate interests of the company (such as improving service delivery and preventing fraud).


You have a legal right to access and, if necessary, correct, supplement or delete your personal data. In certain cases listed in the GDPR, you may also request to restrict the processing of your personal data. You can also object to the processing of your personal data if you have serious and legitimate reasons that outweigh our necessity to process your data. By submitting a written, dated, and signed request to Jar&Joy, Agoralaan building B, 3590 Diepenbeek, jar.and.joy2025@gmail.com, you can request your personal data in a digital and readable format free of charge and/or have it transferred to other controllers. As far as our processing is based on your prior consent, you have the right to withdraw that consent.


In the event of data being used for direct marketing: You can object free of charge to the use of your data for direct marketing and do not need to provide a reason for this.

Article 13: Impairment of validity - non-waiver


If any provision of these Terms is declared invalid, illegal or void, this shall in no way affect the validity, legality and applicability of the other provisions.


The failure at any time by Jar&Joy to enforce any of the rights listed in these terms, or to exercise any right hereunder, shall never be construed as a waiver of such provision and shall never affect the validity of these rights.


Article 14: Amendment of Conditions


These Terms are supplemented by other terms to which explicit reference is made, and the general sales conditions of Jar&Joy. In the event of a conflict, these Terms shall prevail.


Article 15: Evidence


The Customer accepts that electronic communications and backups may serve as evidence.


Article 16: Applicable Law – Disputes


Belgian law shall apply, with the exception of the provisions of international private law regarding applicable law.


The courts of the Consumer's place of residence have jurisdiction in legal disputes. The Consumer can also turn to the ODR platform (http://ec.europa.eu/consumers/odr/).


Jar&Joy has endorsed the Regulations of the UNIZO e-commerce label. A copy of these Regulations and access to the UNIZO complaints procedure is available viahttps://www.unizo.be/uw-webshop-juridisch-waterdicht-dankzij-het-unizo-e-commercelabel.
